The possibility of young women remaining in prisons to take care of their children and the establishment of district educational centers on the basis of correctional facilities are some of the provisions of the new law on support and rehabilitation of minors, the deputy minister said. On Monday, the deputy minister visited a penitentiary for girls in Zawiercie, where 31 young women remain. Four of them have children and are currently under the care of their grandparents.

The new act on the support and rehabilitation of minors follows the work of a parliamentary subcommittee and is due to be adopted by parliament this week, Vos said. “The hypothesis of this law is to adapt the rehabilitation measures we apply to the needs,” he said, adding that the new law would “introduce changes that should be in line with today’s most important challenges, as well as the nature of the crime.” such as basic security rights. “

The Deputy Minister expressed confidence that girls under the age of 21 living in prisons are now in a worse situation than women in prisons. The latter have the right to care for their children up to the age of three, while those in correctional facilities have very limited contact with their children.

“We are changing it. Of course, there will always be a court decision, but minors who decide to stay with their children (stay in production – PAP), of course, will be able to deal with all these conditions, especially security issues with these children. can stay in a rehabilitation facility, “Vos said, adding that he believed that contact with children had a positive effect on the rehabilitation process.

According to him, the act should include rules for cooperation between rehabilitation centers and local communities and non-governmental organizations. The deputy head of the Ministry of Justice disagrees with the allegations that this is due to “excessive restrictions.” “It simply came to our notice then. We want to adapt the means available by the state to guide these young people (…), ”he said.

According to the Deputy Chief of the Ministry of Justice, now the whole state machine, including the courts, is used, even in less serious crimes. Now, in such cases, school principals and police must have new tools without the involvement of the courts. He added that in the most serious crimes, the courts should first consider placement in a penitentiary institution, and only then take more mitigating measures. The perpetrators of such crimes must also be placed under state control after their release, for example, under the supervision of a probation officer.

The MS also intends to apply an indirect model between penitentiaries and youth education centers for less serious and more serious offenders (currently numbering about 4,000 young people). District educational centers should be established on the basis of penitentiaries throughout the country. This is a postulate put forward by family judges and educators, Woś said.

As he explained, due to the nature and attitude of their actions, people who should not go to youth education centers turn to district centers. As the law changes, family judges will be required to look at the records of minors in youth care centers and decide which institution would be more appropriate in a particular case. “The argument that it has been raised for years that throwing everyone in a bag in educational centers for young people is a pathology is true, so we are changing it,” he concluded.

During his visit to Zawiercie, Deputy Minister Woś was also fired by journalists, including some court chiefs. According to him, the ministry is guided only by material criteria. He called the allegations “political nonsense.” “We are always guided by dignity,” he said.
