Sebastian K. and Dżesika N., two 20-year-olds who were illegally sentenced to 25 years in prison in the first instance for the brutal murder of a friend in Rzeszow, began their appeal on Monday. The accused was 17 years old at the time of the crime.

Because the alleged act was committed after the age of 17 and under the age of 18, the maximum penalty for murder, ie life imprisonment, is not imposed; In June 2021, the 25-year prison sentence imposed by the Przemyśl District Court was the maximum amount that could be given to these defendants.

Only Dżesika N. was present at the Court of Appeal in Rzeszow on Monday. The accused had previously applied for a hearing at the Lublin Correctional Facility. Sebastian K. was not in the courtroom because he did not make such a motion. Judge Sigmunt Dudzinski, chairman of the panel of judges, explained that the accused were not required to appear in person at the appeal hearing.

Acting in concert with Sebastian K. Dżesika, he is responsible for the particularly brutal killing of his friends, Wojciech P., with at least 36 ax blows to the head, trunk, neck, neck and limbs.

And Dżesice accused prosecutor Sebastian of conspiring to assassinate Wojciech P. together. The girl had to bring an ax to the accused and persuade him to kill her. They also had to kick, hit and jump on people. After the murder, the body was thrown into a ditch near the house of the victim’s mother.

During the investigation, both defendants were examined by a team of expert psychiatrists and psychologists, who concluded that neither Sebastian nor Dzesika had any limited or canceled opportunities to understand the meaning of the act and could direct their proceedings. that is, they are sane and could answer in court.

In the case of the girl, it was enough for the experts to conduct a single examination to assess the degree of sanity in the movement. However, the youth experts gave their opinion after four weeks of observation (the court agreed).

Earlier, they also examined the accused once, but then decided that a longer observation was needed to get a complete and final diagnosis of Sebastian’s mental state during the act and to give an opinion on the matter.

On Monday, Dżesika’s defense filed an appeal with the appellate court for an expert opinion on the defendants’ sexual and emotional disorders. However, the appellate court did not grant the application, finding that there was no place for such tests on the basis of expert opinions that had already been hired.

The trial in the Przemyśl District Court began in September 2020. The verdict was issued in June 2021.

The court found the juveniles particularly discouraged and sentenced both to 25 years in prison, including more than two years in pre-trial detention.

In addition, both are required to pay 25,000 PLN each by a court of first instance. gold compensation to the mother of the murdered Wojciech P.

The incident ended with a crime

The murder took place in April 2019 in Slonne (Subcarpathian Voivodeship) near Dubiecko. During a drinking party in the house where Dzesika’s mother lived with both teenagers and Wojciech P., the man harassed and abused the girl. There was a fight between him and Sebastian K. Dzesika then fled the basement for the ax he had given Sebastian, as the investigation revealed, and persuaded him to kill her.

According to the indictment, Wojciech P. received multiple cuts and bruises on his head, neck, limbs and back. The direct cause of death was a fracture of the skull and a fracture of the brain.

The accused then had to cover the body with a sheet, put it on wheels and take it to the victim’s house. There they were thrown into a roadside ditch. When they returned home, they washed away the traces of blood on the tires, the ax and the apartment.

During the interrogation, both of them pleaded guilty to the charges. While visiting the scene, they accurately described the course of events. The image confirmed the prosecutor’s findings on the basis of evidence.
